Wedding Photography Agreement This agreement is made between: **Photographer:** Kerry Morgan, hereafter referred to as “the Photographer” **Clients:** Eirwen Parker and Alex Cox, hereafter referred to collectively as “the Client” Booking Details **Wedding date:** Wednesday 22 September 2027 **Venue:** Domaine de la Grangette, Montagnac, France **Photography coverage:** From one hour before the ceremony until the Client and their guests are seated for dinner. **Total photography fee:** €1,650 **Booking fee / acompte:** €750, payable on booking **Remaining balance:** €900, payable in cash on the wedding day Included * Professional photography during the agreed coverage period * Professionally edited high-resolution photographs * Private online gallery for viewing, sharing and downloading * Personal printing rights * Travel to Domaine de la Grangette The Client’s address, telephone number and any additional information requested by the Photographer will be completed by the Client in the online booking form and form part of this agreement. If there is any conflict between these Booking Details and the general terms below, the Booking Details above shall apply to the wedding date, venue, photography coverage, total fee, payment schedule and package inclusions. These terms shall apply to all other matters. Where more than one Client is named, each Client is jointly responsible for all obligations under this agreement, including payment. 1. Booking & Payment 1.1 To secure the wedding date, the Client must complete and submit the online booking form, accept these terms, and pay the booking fee / acompte of €750. 1.2 The booking is not confirmed and the date is not reserved until both the completed booking form and the €750 acompte have been received. 1.3 The booking fee / acompte is deducted in full from the total photography fee. 1.4 The remaining balance of €900 is payable in cash on the wedding day. 1.5 The Photographer is not required to provide services where payment has not been made in accordance with the agreed payment schedule. 1.6 If payment is late, the Photographer may suspend work, withhold delivery of images, or treat the booking as cancelled by the Client where legally permitted. 2. Cooling-Off Period 2.1 Where applicable, the Client may cancel the booking within fourteen (14) days of entering into this agreement and receive a full refund of monies paid. 2.2 If the Client asks the Photographer to begin work within this fourteen-day period, including planning, consultation, administration, supplier communication, schedule review or other preparation, the Client agrees that reasonable charges may be deducted for work already carried out if the booking is subsequently cancelled. 2.3 After any applicable fourteen-day withdrawal period has expired, the booking fee / acompte is non-refundable in accordance with the cancellation provisions below, except where otherwise required by law. 3. Cancellation by the Client 3.1 The Client may cancel this agreement by giving written notice to the Photographer. 3.2 If the Client cancels more than nine (9) months before the wedding date, the booking fee / acompte is retained and no further cancellation fee is due. 3.3 If the Client cancels less than nine (9) months before the wedding date, the following cancellation fees apply: **6 to 9 months before the wedding date:** 50 percent of the remaining balance is due. **3 to 6 months before the wedding date:** 75 percent of the remaining balance is due. **Less than 3 months before the wedding date:** The full remaining balance is due. 3.4 “Remaining balance” means the total photography fee minus the €750 booking fee / acompte. 3.5 Any payments already made by the Client will be credited against the applicable cancellation fee. 3.6 These cancellation fees reflect the reserved date, the likelihood of the Photographer being unable to rebook the date at short notice, administrative work already carried out, loss of opportunity and the Photographer’s business costs. 3.7 If the Photographer is able to rebook the cancelled date for comparable wedding photography work, any cancellation fee beyond the retained booking fee / acompte may be reduced at the Photographer’s discretion to reflect the replacement booking. 3.8 Clients are strongly advised to obtain wedding insurance covering cancellation, postponement, illness, travel disruption, venue issues and other potential losses. 4. Rescheduling by the Client 4.1 If the Client wishes to reschedule the wedding, this must be requested in writing as soon as possible. 4.2 Rescheduling is subject to the Photographer’s availability and is not guaranteed. 4.3 If the wedding is rescheduled for reasons other than force majeure or circumstances genuinely outside the Client’s reasonable control, a new booking fee may be required. 4.4 If the Photographer is unavailable for the new date, this will be treated as a cancellation by the Client and the cancellation terms in section 3 will apply, subject to any mandatory rights available under applicable law. 5. Cancellation or Non-Attendance by the Photographer 5.1 If the Photographer is unable to attend due to serious illness, accident, bereavement, force majeure or circumstances genuinely outside the Photographer’s reasonable control, the Photographer will make reasonable efforts to help the Client find a replacement photographer. 5.2 The Photographer cannot guarantee the availability, suitability, style, pricing, conduct or performance of any replacement photographer. 5.3 If no replacement photographer is arranged, the Photographer will refund all monies paid by the Client for the wedding photography services not provided. 5.4 The Photographer’s liability for cancellation or non-attendance is limited to a refund of monies paid, except where such limitation is not permitted by law. 6. Creative Control & Image Editing 6.1 The Photographer has full creative and artistic discretion over image selection, editing style, black and white conversion, colour treatment, composition, cropping and final output. 6.2 Reasonable Client requests may be considered, but they are not guaranteed. 6.3 Images that are technically flawed, duplicated, unflattering, artistically unsuitable or inconsistent with the Photographer’s professional standards will be permanently deleted. Unselected images are not available for viewing, purchase or delivery. 6.4 The Client will receive a mixture of colour and black and white images. 6.5 Formal portraits of the Client will be delivered in both colour and black and white where reasonably possible. Portraits of guests and all other images will be edited at the Photographer’s discretion. 6.6 Requests for additional colour versions, black and white versions, re-edits, object removal, body retouching, facial retouching, background changes or other specialist editing are not included unless agreed in writing. 6.7 The Client acknowledges that colour, brightness, contrast and sharpness may vary between monitors, phones, tablets, printers and print labs. Such variations are not grounds for re-editing, rejection of images or refund. 7. Exclusivity, Cooperation & Guest Interference 7.1 The Photographer must be the sole professional still photographer appointed by the Client for the wedding day. 7.2 If another professional still photographer is present in a working capacity without prior written agreement, the Photographer may ask that person to stop working, may limit coverage, or may cease coverage if the situation prevents the Photographer from working properly. No refund will be due for missed images caused by such interference. 7.3 The Client must tell the Photographer in advance if a videographer, content creator, planner, stylist or other visual supplier will be present. 7.4 Videographers, content creators, guests, suppliers and venue staff must not obstruct the Photographer, duplicate posed shots, interrupt group photographs, direct the couple during the Photographer’s allocated time or prevent the Photographer from carrying out the agreed work. 7.5 The Photographer is not responsible for missed images caused by lack of cooperation, insufficient time, late running, guest interference, venue restrictions, supplier interference, weather, poor light, access issues or restrictions imposed by the officiant. 7.6 The Client agrees to allow reasonable time for group photographs, couple portraits and any other requested photographs. If the schedule does not allow enough time, the Photographer is not responsible for failing to capture all requested images. 8. Copyright & Client Licence 8.1 The Photographer retains full copyright and intellectual property rights in all images. 8.2 The Client receives a personal-use licence to download, print, store and share the delivered images for personal and family use. 8.3 The Client may not edit, crop, filter, alter, sell, license, submit to publications, enter into competitions, provide to suppliers for business use or use the images commercially without the Photographer’s prior written permission. 8.4 The Client may share images on personal social media, provided the images are not altered and reasonable credit is given where practical. 8.5 The Client may not provide images to wedding venues, planners, florists, designers, bridal shops, caterers, make-up artists, hair stylists, musicians, content creators or any other suppliers for promotional, commercial, editorial or business use. 8.6 Any third party wishing to use images must obtain permission directly from the Photographer and may be required to pay a licensing fee. 9. Photographer Image Use 9.1 The Photographer’s use of identifiable photographs of the Client for promotional purposes is separate from the wedding photography service itself. 9.2 The Client will be given a separate choice on the booking form as to whether they authorise the Photographer to use identifiable photographs of them for the Photographer’s: * portfolio * website * professional social media * advertising and promotional materials * printed portfolios and brochures * sample albums * professional awards, competitions and submissions 9.3 Giving this permission is optional and is not required in order to book the Photographer. 9.4 Where the Client gives permission, the authorisation applies for a period of ten (10) years from the wedding date, unless withdrawn earlier in writing. 9.5 The Client may withdraw permission for future promotional use by contacting the Photographer in writing. The Photographer will cease new digital promotional use within a reasonable period following receipt of the request. Withdrawal does not require the Photographer to recall or destroy printed materials already produced or publications already distributed. 9.6 The Photographer will not sell identifiable wedding photographs as stock photography or use them in a manner falsely implying that the Client endorses a third-party product or service. 9.7 The Client’s authorisation relates to the Client’s own image and does not automatically grant rights over identifiable images of other wedding guests. 9.8 The Client agrees to inform guests that photography will take place during the wedding. 9.9 The Photographer will take reasonable care when considering promotional use of photographs containing identifiable guests or children and will consider specific requests concerning such images in accordance with applicable law. 10. Ceremony & Venue Restrictions 10.1 The Client is responsible for confirming with the officiant, venue, planner and any relevant authority that photography is permitted throughout the ceremony and wedding day. 10.2 The Photographer is not liable for missed images due to restrictions imposed by the officiant, venue, planner, staff, security, religious authority, celebrant, registrar or any other person with authority at the event. 10.3 The Client is responsible for obtaining any required permits, permissions, access passes, parking permissions or venue approvals needed for photography. 11. Delivery & Image Storage 11.1 Final edited images will be delivered via an online gallery. 11.2 The expected delivery time is within one month of the wedding date. 11.3 During busy periods delivery may take longer, and the Photographer will advise the Client where reasonably possible. 11.4 Delivery times are estimates and are not guaranteed unless expressly agreed in writing. 11.5 The online gallery will remain available for three (3) months from the date of delivery. 11.6 The Client is responsible for downloading and backing up all images within the gallery availability period. 11.7 After the gallery has expired, images may be archived or permanently deleted at the Photographer’s discretion. 11.8 Retrieval of archived images, if available, may incur an administration fee. 11.9 The Photographer is not responsible for the Client’s failure to download, store, back up or preserve the images after delivery. 12. Technical Failure & Image Loss 12.1 The Photographer will take reasonable professional measures to prevent image loss, including using appropriate camera equipment, memory cards and backup procedures. 12.2 The Client acknowledges that photography involves equipment, storage media, software, online platforms and data systems, and that failures can occur despite reasonable care. 12.3 In the unlikely event of partial image loss, technical failure, corruption, theft, damage or another problem affecting some images, the Photographer’s liability is limited to a fair and reasonable refund reflecting the proportion of the service affected. 12.4 In the unlikely event of total photographic failure, the Photographer’s liability is limited to a full refund of all monies paid for the wedding photography services. 12.5 No further claims may be made for consequential or indirect loss except where such limitation is not permitted by law. 13. Force Majeure 13.1 The Photographer is not liable for failure or delay in performing this agreement where this is caused by circumstances beyond the Photographer’s reasonable control. 13.2 Such circumstances may include extreme weather, natural disaster, fire, flood, serious illness, accident, bereavement, epidemic, pandemic, government restriction, road closure, transport disruption, civil unrest, terrorism, war, venue closure, legal restriction or another event that could not reasonably have been avoided. 13.3 If force majeure affects the wedding, the parties will try to agree a reasonable solution, including rescheduling where possible. 13.4 Rescheduling is subject to the Photographer’s availability. 14. Safety & Working Conditions 14.1 The Client must provide a safe and reasonable working environment for the Photographer. 14.2 The Photographer may cease coverage and leave the event if working conditions become unsafe, hostile, abusive, threatening, discriminatory or otherwise unreasonable. 14.3 This includes aggressive behaviour, threats, harassment, intoxicated behaviour, unsafe structures, dangerous weather exposure, unsafe travel or any situation presenting a risk to the Photographer, the Photographer’s equipment or others. 14.4 If the Photographer ceases coverage for safety reasons, no refund will be due for missed coverage or missed images, except where otherwise required by law. 15. Meal Requirement 15.1 If coverage exceeds four (4) hours, the Client agrees to provide the Photographer with a hot meal. 15.2 The meal should be served at the same time as the wedding breakfast or main guest meal, so that the Photographer does not miss key moments. 15.3 If no meal is provided, the Photographer may leave the venue for a reasonable time to obtain food. The Photographer is not responsible for missed images during this time. 16. Additional Time & Retouching Fees 16.1 Additional photography coverage is charged at €300 per hour, subject to the Photographer’s availability. 16.2 Additional time must be agreed by the Client and the Photographer. 16.3 Specialist retouching requested by the Client is charged at €75 per hour. 16.4 Specialist retouching includes body retouching, skin retouching beyond the Photographer’s normal edit, object removal, background alteration, face swaps, clothing correction, extensive colour changes and other detailed editing work. 17. Travel & Expenses 17.1 Travel required for the Photographer to attend Domaine de la Grangette in Montagnac for this booking is included in the agreed total fee of €1,650. 17.2 If the Client subsequently requests photography at additional locations that create material additional travel, accommodation, parking, toll or transport costs, any additional costs will be agreed with the Client in writing before they are incurred where reasonably possible. 17.3 The Photographer is based in France. 18. Privacy & Data Protection 18.1 The Photographer will store and process Client details for the purposes of managing the booking, providing the photography service, communicating with the Client, issuing invoices, delivering images and keeping appropriate business records. 18.2 Wedding photographs may include personal data because they may show identifiable people. 18.3 Client details will not be sold to third parties. 18.4 Client details may be shared only where reasonably necessary for the operation of the business, such as gallery delivery, accounting, legal compliance, payment processing or where required by law. 18.5 The Photographer’s privacy policy is available at: https://kerrymorgan.com/privacy-policy/ 18.6 Requests relating to personal data should be made in writing. 19. Complaints & Consumer Mediation 19.1 Any complaint should be made in writing within 28 days of the issue arising wherever reasonably possible, so that the Photographer has a fair opportunity to respond and, where appropriate, put matters right. This does not remove or reduce any mandatory statutory rights available to the Client. 19.2 The parties agree to try to resolve any disagreement amicably before taking further action. 19.3 Where applicable under French consumer law, after first making a written complaint to the Photographer and where the dispute has not been resolved, the Client may refer the matter to the Photographer’s appointed consumer mediator: **CM2C Centre de la Médiation de la Consommation de Conciliateurs de Justice 49 Rue de Ponthieu 75008 Paris France** Email: [declarer-un-litige@cm2c.net](mailto:declarer-un-litige@cm2c.net) Website: [www.cm2c.net](http://www.cm2c.net) 20. Liability 20.1 Subject to any liability that cannot legally be excluded or limited, the Photographer’s total contractual liability under this agreement is limited to the total amount paid by the Client for the wedding photography services. 20.2 The Photographer is not liable for indirect loss, consequential loss, emotional distress, loss of enjoyment, loss of opportunity, replacement costs, travel costs, venue costs, supplier costs or other associated losses except where such liability cannot legally be excluded or limited. 20.3 Nothing in this agreement limits or excludes liability where such limitation or exclusion is not permitted by law. 21. Governing Law 21.1 This agreement is governed by the laws of France. 21.2 This agreement is written in English because the Client is English-speaking. 21.3 Nothing in this agreement removes any mandatory consumer rights that apply by law. 22. Agreement 22.1 By submitting the online booking form, accepting these terms and paying the €750 booking fee / acompte, the Client confirms that they have read, understood and agreed to this agreement. 22.2 The person submitting the online booking form confirms that they have authority to enter into this agreement on behalf of all named Clients. 22.3 This agreement, together with the completed online booking form, forms the full agreement between the Photographer and the Client.
