Portrait Session Contract

This agreement is made between Kerry Morgan Photography (“The Photographer”) and the undersigned Client (“The Client”). Both parties agree to the following terms and conditions, which form an integral part of this contract. By submitting this form, The Client acknowledges they have read, understood, and agree to these terms.

1. Deposit/Payments

• A deposit of £150 is due immediately upon booking to secure the session date.
• The remaining balance is due 7 days prior to the shoot date.
• All payments made are non-refundable and non-transferable to another date.
• No photography will take place until full payment is received.

2. Creative License

• The Photographer retains creative and artistic control over the session, including the selection of poses, lighting, artistic style, and the number of photographs taken.
• The Photographer shall endeavour to accommodate The Client’s specific requests where feasible, subject to cooperation from the subjects.
• The Photographer has sole discretion in selecting the final images for editing and presentation. Images rejected during the editing process will be permanently deleted.

3. Display and Copyright

• The Photographer retains copyright over all images created during the session.
• The Photographer may use the images for promotional purposes, including portfolios, websites, exhibitions, and advertising, unless a confidentiality clause is agreed upon in advance and subject to an additional fee.
• The Client may use the images for personal purposes, including sharing on personal websites (e.g., for wedding announcements) or social media platforms. Use for commercial purposes, third-party publications, or websites other than those operated by The Client requires prior written consent from The Photographer.
• When images are posted on social media or websites, The Client agrees to include credit to The Photographer by tagging and mentioning @kerrymorgan.photography, Kerry Morgan Photography, or providing a hyperlink to the Photographer’s website where applicable. Failure to provide both tagging and mention constitutes a breach of this agreement and may result in additional fees.

4. Force Majeure

• The due performance of this contract is subject to alteration or cancellation due to circumstances beyond The Photographer’s control, including but not limited to natural disasters, illness, or government restrictions.
• In the unlikely event of cancellation by The Photographer, liability shall be limited to a full refund of all monies paid.

5. Cancellation Policy

• The Client may cancel this contract up to 3 months before the shoot date by providing written notice to The Photographer.
• If cancellation occurs less than 3 months before the shoot date, The Client will remain liable for the full payment.
• The Photographer advises The Client to take out appropriate insurance to cover any unforeseen cancellations or disruptions.

6. Timescale

The Photographer will make every effort to deliver the final edited images within 30 days of the shoot. Delivery times may be extended during busy periods, with prior notice to The Client.

7. Exclusivity

• The Photographer will be the sole professional still photographer at the session.
• Guests may take photos in an amateur capacity, provided it does not interfere with The Photographer’s work. The Photographer reserves the right to stop shooting if interference occurs.
• The presence of another professional photographer or videographer not pre-approved by The Photographer will nullify this agreement.

8. Travel

• The Photographer will cover their own travel costs to the agreed shoot location.
• During the session, The Client agrees to cover all transport costs incurred by The Photographer, including but not limited to taxis, road tolls, parking, and public transport.

9. Retouching

• The Photographer provides basic retouching, including blemish removal and colour correction, as part of the service.
• Specialist retouching requests will incur an additional fee of £95 per hour.

10. Extra Time

• Should The Client require The Photographer to extend beyond the agreed session hours, an additional fee of £150 per hour will apply.
• Additional time is subject to The Photographer’s availability and discretion.

11. Privacy

The Photographer may store The Client’s personal data in a private, secure database for contract fulfilment and future communications. This data will not be shared with third parties. The Client may request its removal in writing.

12. Jurisdiction

This contract is governed by and construed under the laws of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

13. Complaints

Any complaints must be raised by The Client in writing within 28 days of the event in question.

14. Verbal or Physical Abuse

The Photographer reserves the right to terminate the session and leave immediately if subjected to verbal or physical abuse by any party connected to the session. No refunds will be issued in such cases.

15. Agreement

By submitting this form, The Client confirms that they have read, understood, and agree to all the terms outlined above. This contract becomes effective immediately upon submission.
