Wedding Photography Contract
This agreement is made between:
• Photographer: Kerry Eskriett (hereafter referred to as “the Photographer”)
• Client(s): The individuals who complete and submit the online contract (hereafter referred to as “the Client”)
1. Booking & Payment 1.1 To secure the wedding date, the Client must pay a non-refundable and non-transferable deposit of €1000 and sign this contract. The booking is not confirmed until both have been received. The deposit is deducted in full from the total price. 1.2 The remaining balance is payable in increments: • 50% of the remaining balance is due three months before the wedding date. • The final balance is due one month before the wedding date. 1.3 The Photographer will not provide services unless full payment has been received by the final due date. 1.4 If the Client wishes to reschedule, a new booking fee may be required, and availability is not guaranteed. A new booking fee will be required if rescheduling occurs for reasons other than force majeure.
2. Cancellation & Refund Policy 2.1 The Client may cancel this contract up to nine (9) months before the wedding date by providing written notice. In this case, only the deposit is retained. 2.2 If cancellation occurs less than 9 months before the wedding date, the following cancellation fees apply: • 6-9 months before: 50% of the remaining balance is due. • 3-6 months before: 75% of the remaining balance is due. • Less than 3 months before: The full balance remains due. Clients are advised to obtain wedding insurance to cover any losses. 2.3 If the Photographer must cancel due to unforeseen circumstances, all monies paid will be refunded in full. The Photographer will also provide reasonable assistance in finding a replacement photographer, though this is not guaranteed. The Photographer’s liability is strictly limited to the refund of all amounts paid and does not extend to consequential losses.
3. Creative Control & Image Editing 3.1 The Photographer has full creative and artistic discretion over image selection, editing style, and final output. Reasonable client requests may be considered but are not guaranteed. 3.2 Unselected images will be permanently deleted and will not be available for review or purchase. Only technically or artistically unsuitable images will be deleted permanently. 3.3 The Client will receive a mixture of colour and black & white images. All portraits will be delivered in both formats; all other images will be edited at the Photographer’s discretion. The final selection of colour vs. black & white is at the Photographer’s discretion and cannot be changed post-delivery.
4. Exclusivity & Guest Interference 4.1 The Photographer must be the sole professional still photographer at the event. If another professional photographer is present in any working capacity, this contract becomes void, and the Photographer reserves the right to withdraw services without refund. The deposit and any fees paid up to that point will not be refunded. 4.2 If a videographer is present, they must not interfere with the Photographer’s positioning or duplicate posed shots. The choice of videographer must be discussed before booking. 4.3 The Photographer is not responsible for missed shots due to guest interference, venue restrictions, or scheduling issues.
5. Copyright & Image Usage 5.1 The Photographer retains full copyright over all images. The Client is granted a personal-use license and may print and share the images but cannot edit, sell, submit them to publications or use them commercially without written permission. 5.2 The Photographer may use images for promotional and commercial purposes unless the Client requests otherwise in writing before the wedding date. 5.3 If the Client requires a confidentiality agreement, this must be arranged before booking and will incur an additional fee.
6. Ceremony & Venue Restrictions 6.1 The Client is responsible for confirming with the wedding officiant that photography is permitted throughout the ceremony. If photography is restricted, the Photographer will not be held liable for any missed images. 6.2 The Photographer will not use flash during the ceremony and will remain as discreet as possible.
7. Delivery Timeline 7.1 The final images will be delivered via an online gallery within one month of the wedding date. During busy periods, delivery may take longer, and the Photographer will advise accordingly. 7.2 The online gallery will remain available for three (3) months. After this period, images may be archived or permanently deleted at the Photographer’s discretion, and retrieval (if available) may be subject to a fee.
8. Force Majeure (Unforeseen Circumstances) 8.1 The Photographer is not liable for failure to perform due to circumstances beyond their control, including but not limited to extreme weather, illness, venue restrictions, technical failure or government restrictions. 8.2 In the unlikely event of total photographic failure, liability is strictly limited to a full refund of all monies paid. 8.3 The Photographer takes all reasonable measures to prevent image loss, including backup procedures, but is not liable for technical failures beyond their control. If images are lost or damaged due to circumstances beyond the Photographer’s control, no claims shall be made against the Photographer.
9. Meals Requirement 9.1 The Client agrees to provide the Photographer with a hot meal if coverage exceeds four (4) hours. 9.2 The meal must be served at the same time as the wedding breakfast to ensure the Photographer does not miss key moments.
10. Additional Time & Retouching Fees 10.1 If the Photographer is required beyond the contracted hours, additional time will be charged at €200 per hour, subject to the Photographer’s availability. 10.2 Any specialist retouching requested by the Client will be charged at €75 per hour.
11. Travel & Expenses 11.1 The Photographer does not charge travel expenses for weddings within mainland France. 11.2 For destination weddings requiring flights, the Client agrees to cover: • Return flights (with the Photographer’s chosen carrier) and any necessary excess baggage fees for photographic equipment. • Public transport, taxi fares, road tolls, parking, and other reasonable transport costs incurred by the Photographer. • If flights are delayed or cancelled, the Client agrees to cover reasonable additional expenses to ensure the Photographer arrives at the destination. These expenses will be kept to a minimum and discussed with the Client where possible.
12. Complaints & Disputes 12.1 Any complaints must be made in writing within 28 days of the issue arising.
13. Privacy Policy 13.1 The Photographer may store the Client’s details on a secure internal database. No data will be shared with third parties. The Client may request removal of their details in writing.
14. Agreement By submitting this form, both parties confirm they have read, understood, and agreed to the terms outlined in this contract.
