It is mutually agreed that the following terms of agreement form the integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Kerry Morgan photography and the client, in writing.
DEPOSIT/PAYMENTS: A standard deposit of €750 is required as confirmation of the booking. This deposit and any future payments are non-returnable and cannot be transferred to another date. The deposit is deducted (in full) from the total price. The remainder of the balance must be paid in advance of the wedding. No photography will take place unless the balance is paid in full before the wedding.The payment is due one month prior to the wedding.
CREATIVE LICENSE: The Photographer shall be granted creative and artistic licence in relation to the choice of poses, lighting effects, artistic style and the number of photographs taken. The Photographer shall endeavour to undertake any set-ups requested by The Client – subject to the willingness and cooperation of the subjects being photographed. The Photographer has the absolute right to select the images that will be shown to The Client. All photographs rejected by The Photographer during the editing process will be permanently deleted and will not be available for The Client to view. The choice and number of photographs shown to The Client will be deemed as correct.
DISPLAY/COPYRIGHT: The Photographer retains the copyright of all images. The Photographer can display any images included in this contract in their studios, portfolios, literature, website, exhibitions, for use in competitions, advertising and commercially. Where The Client receives the image files as part of their contract they are only permitted to make prints for their own private use – this precludes use on any website unless written permission is granted by The Photographer. Confidentiality clauses can only be considered prior to booking and will be subject to a fee.
FORCE MAJEURE or ACT OF GOD: The due performance of the contract is subject to alteration or cancellation by The Photographer owing to any cause beyond the control of The Photographer. In the unlikely event of the total photographic failure or cancellation of this contract by Photographer liability shall be limited to a full refund of all monies paid. In the event of loss or damage beyond The Photographers control no claims can be made against The Photographer.
TIMESCALE: Every effort is made to present the images to The Client within one month of the wedding. On occasion due to time of year and workload aforementioned timescale may be increased.
COMPLAINTS: Any complaint should be raised by The Client with The Photographer in writing within 28 days of the matter in question arising.
EXCLUSIVITY: The Photographer will not photograph any wedding where another professional/amateur photographer is/are present in a working capacity including but not limited to photographer(s) independently covering the wedding for intended publication in a magazine or on a website and/or friend(s)/family member(s) infringing the work of The Photographer as this could adversely affect The Photographer carrying out her work to the best of her ability. Guests may use cameras in an amateur capacity but The Photographer reserves the right to stop shooting if this interferes with The Photographer’s coverage. The presence of another photographer in any capacity as aforementioned at the engagement will null & void all obligations contained herein pertaining to The Photographer and will result in The Photographer terminating the shoot.
INSTRUCTION: The Photographer will only take instruction from The Client on any matter relating to the contents of this agreement regardless of who is settling the balance.
SPECIAL REQUESTS/COVERAGE: The Client understands and accepts that the photographic coverage will be as The Photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with The Client’s wishes. This contract is exclusively for the package and price as indicated above. Bridal preparation means 2 hours prior to ceremony. Hours outside of this time are charged at €200 per hour. The hours that Kerry Morgan will photograph will be consecutive hours and limited to the day of the wedding. If for any reason the full quota of hours is not used up on the wedding day, the remaining time will not be transferable.
VERBAL OR PHYSICAL ABUSE: The Photographer reserves to the right to leave the wedding if she is subject to verbal or physical abuse from anyone attending or connected with the wedding.
IMAGE SIZES: All image sizes stated are approximate. On some print sizes, such as 10×8 and 8×6 which are often required for frames, cropping will occur at the edges of the frame/photograph. Please include exact frame sizes at the point of ordering.
COLOUR/BLACK AND WHITE RATIO OF IMAGES: The Client will receive the pictures in both formats for their posed portraits and a mixture throughout the rest of the images, with the biased being on colour.
VIDEOGRAPHERS: The Client agrees that The Photographer will be the sole professional still photographer. If the Client employs a videographer for video coverage, all parties will agree that the videographer and/or their associates will not take still images. Where the clients are considering the use of a videographer, the choice of videographer is to be discussed with The Photographer prior to the videographer being booked. The Client agrees that the Photographer will be given priority over camera position and authority regarding the videographer and/or their associates.
CEREMONY COVERAGE
The Client agrees to check with the official conducting the wedding ceremony that photography is allowed throughout the entirety of the ceremony and confirm this with The Photographer. If photography is not allowed throughout the entirety of the ceremony The Photographer reserves the right to terminate this contract. The photographer agrees not to use flash and be as discreet as possible.
RETOUCHING: Any specialist retouching requested by the client will be charged at €85 per hour.
EXTRA TIME: Should The Photographer be required for longer than the time stated on the contract, The Client agrees to pay The Photographer an additional €200 per hour. Extra time is subject to The Photographer’s discretion. The Photographer reserves the right to leave wedding upon execution of contracted hours/time.
MEALS: The Client agrees to provide The Photographer a hot meal if she is required for longer than 4 hours. This meal should be provided at the same time as the wedding breakfast. The reason for this is that The Photographer cannot leave the wedding at any point to get a meal and the only time photographs are not taken is during this time. Soft drinks must be available to the photographer throughout the day. The same applies if a second photographer option is taken.
PRIVACY: The photographer may store your data on a private internal database. This data will not be made available to outside companies or individuals. Should you wish to have your data removed from the database, please advise in writing and retain your confirmation.
CANCELLATION: The Client may repudiate this contract up to 9 months prior to the Wedding date by giving written notice to The Photographer. Failure to give notice up to 9 months prior to the date will result in The Client’s full payment in accordance with the agreed sum. The client is hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.
I have read and fully understand the schedule and terms of agreement of this Contract and realise that this Contract becomes effective immediately.
